Pa. Kmart Shopper Wins Toilet Paper Lawsuit
MONROEVILLE, Pa. (AP) ―
A Murrysville woman has won her lawsuit against a Monroeville Kmart store that wrongly charged her sales tax on toilet paper.
Mary Bach won $100 plus court costs Thursday from a district judge in Monroeville.
Bach
sued after she was twice charged 28 cents, seven percent sales tax on a
$4 package of toilet tissue, at the Kmart store in Monroeville.
Kmart says it won't appeal the ruling because they don't want to fight with a customer.
Instead, the discount chain is working to correct the problem.
In Pennsylvania, clothes and some other items deemed necessities, including toilet paper, are exempt from sales tax.
