Hearing Scheduled For Suspect In Bensalem Crash

Bensalem, Pa. (CBS 3) ― A preliminary hearing is scheduled Wednesday for a suspect accused of intentionally striking a Bucks County restaurant employee with a vehicle over the weekend.

Jose Maldonado-Luzuriaga was charged with criminal homicide and related charges after fatally crashing into 30-year-old William Sullo II at Salute Restaurant in Bensalem at Police.about 10:30 p.m. Saturday.

Maldonaldo-Luzuriage, who has been living in the country illegally for up to five years, was apparently denied a drink from the bartender as he was said to be visibly intoxicated.

After being escorted from the bar, the unlicensed suspect allegedly entered his Ford F-150 and drove around the parking lot several times before heading toward the front entrance.

The truck crashed into Sullo, who was on a break at the time. Sullo was trapped in between the truck and a concrete wall. He was rushed to Frankford-Torresdale Hospital where he was pronounced dead.

A bouncer, Carl Slaton, narrowly escaped the path of the vehicle. He was able to restrain Moldonaldo-Luzuriaga, until police arrived on scene. He was arraigned and sent to Bucks County Prison on $3 million bail.

David Zellis, the first assistant District Attorney for Bucks County said that it is alleged that this is an "intentional knowing or reckless act on part of the defendant" and that he could serve a maximum of 20 to 40 years for criminal homicide, a felony of the first degree.

If charged, the Maldonaldo-Luzuruaga will serve his time here, in the United States. After the completion of his sentence authorities will decide if he is permitted to remain in the country.

Officials said the bar sustained heavy damage in the crash and will be closed until it can be deemed safe.
