A judge has denied bail for a 72-year-old man who was charged with murder four decades after he shot a Philadelphia police officer.
Judge Shelley Robins New says it's outside the court's authority to decide whether William Barnes can be released on bail.
She said at a hearing Thursday that the state constitution says a defendant charged with first-degree murder isn't entitled to bail.
In the complex case, Barnes previously served 20 years for wounding and paralyzing police Officer Walter Barclay while attempting to escape arrest in 1966.
Then Barclay died in August 2007, at age 64, of complications prosecutors say resulted from the 1966 shooting. Now Barnes is charged with murder.
